TUTCH TERMS AND CONDITIONS

Effective Date: 1 March 2026

1. Introduction

Welcome to Tutch.

These Terms and Conditions ("Terms") govern your access to and use of the Tutch website at www.tutch.me, the Tutch mobile application, and any related products, services, features, content and functionality (collectively, the "Services").

The Services are operated by Mobile Chat Limited, a company registered in England and Wales under company number 13341196, with its registered address at Park Avenue, Harrogate, HG2 9BG, United Kingdom ("Mobile Chat Limited", "Tutch", "we", "us" or "our").

By downloading, installing, accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

Please also read our Privacy Policy, which explains how we collect, use and protect personal information.

2. About Tutch

Tutch is a communication platform designed to enable users to communicate and interact with other users in real time.

The Services may include:

  • Live video communication;

  • Live audio communication;

  • Real-time interactive communication;

  • Augmented reality and interactive visual features;

  • Visual effects and filters; and

  • Other communication features introduced from time to time.

Tutch currently provides live communication functionality. Features may change as we develop and improve the Services.

We may modify, add, suspend or discontinue features where reasonably necessary.

3. Eligibility and Minimum Age

You must be at least 13 years old to create an account or use Tutch.

If you are under the age of majority in the country where you live, you confirm that you have any consent required from a parent or legal guardian to use the Services.

You must not use Tutch if:

  • You are under 13 years old;

  • You have previously been permanently suspended from Tutch unless we expressly permit you to return; or

  • You are prohibited from using the Services under applicable law.

Parents and legal guardians are responsible for supervising minors where supervision is required by applicable law.

We may take reasonable steps to verify age or eligibility where necessary to protect users or comply with applicable law.

4. Creating an Account

Certain features of Tutch require you to create an account.

When creating and maintaining an account, you agree to:

  • Provide accurate and complete information;

  • Keep your information reasonably up to date;

  • Keep your login credentials secure;

  • Not allow another person to improperly access or use your account;

  • Not create an account using false or misleading information;

  • Not impersonate another person; and

  • Notify us promptly if you believe your account has been accessed without authorisation.

You are responsible for activity occurring through your account where this results from your failure to keep your account or device secure.

We may suspend or terminate accounts that we reasonably believe are fraudulent, misleading, unlawful or in breach of these Terms.

5. SMS TEXT MESSAGING AND PHONE VERIFICATION

5.1 Tutch SMS Verification Service

Tutch, operated by Mobile Chat Limited, may send SMS text messages to users for the purpose of verifying a telephone number during account registration, account access or other security-related processes.

The Tutch SMS programme is primarily used for transactional authentication and one-time password ("OTP") messages.

Tutch does not use this SMS programme to send marketing or promotional messages unless you separately and explicitly consent to receive such communications.

5.2 How You Consent to Receive SMS Messages

During the Tutch account onboarding process, you may be asked to provide your mobile telephone number.

By entering your mobile telephone number and actively selecting the option to request a verification code, you consent to receive a one-time SMS verification message from Tutch at the telephone number you provide.

You initiate the verification process yourself by requesting the verification code.

Tutch does not use unsolicited SMS messages to obtain your consent.

SMS messages are sent to verify that you control the telephone number provided and to help protect the security of your Tutch account.

5.3 Message Frequency

Message frequency varies.

You will normally receive one SMS message for each verification code that you request.

You may receive additional messages if you request another verification code or repeat the verification process.

Tutch does not send recurring marketing messages as part of this SMS verification programme.

5.4 Message and Data Charges

Message and data rates may apply.

Your mobile network operator may charge you for sending or receiving SMS messages in accordance with your mobile telephone service plan.

5.5 Opting Out

You may opt out of receiving SMS messages from Tutch by replying STOP to a message from Tutch.

Other recognised opt-out keywords may include UNSUBSCRIBE, END, QUIT or CANCEL, depending on your mobile network and messaging provider.

After opting out, you may no longer be able to receive SMS verification codes or complete processes that require verification by SMS unless an alternative verification method is available.

5.6 Help and Customer Support

For assistance with Tutch SMS messages, reply HELP to a Tutch message where supported by your messaging provider.

5.7 SMS Delivery

SMS messages may be delayed, blocked or not delivered due to circumstances outside Tutch's control, including mobile network availability, device compatibility or telecommunications provider issues.

Carriers are not liable for delayed or undelivered messages.

We cannot guarantee the delivery or timing of SMS verification messages.

5.8 Privacy and Mobile Information

Your use of Tutch is also governed by our Privacy Policy.

Mobile telephone numbers and SMS verification information are used only as described in our Privacy Policy and as necessary to provide, secure and operate the Tutch Services.

We do not share, sell, rent or transfer your mobile telephone number or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes.

5.9 Verification Codes

Verification codes are intended solely for the person who requested them.

You must not:

  • Share a verification code with another person;

  • Allow another person to use a verification code to access or create an account;

  • Attempt to obtain verification codes for telephone numbers that you do not control; or

  • Use Tutch's SMS verification system for fraudulent purposes.

Tutch will never ask you to provide your verification code to another user.

6. Acceptable Use

You agree to use Tutch responsibly and lawfully.

You must not use the Services to:

  • Break any applicable law or regulation;

  • Harass, threaten, bully, intimidate or abuse another person;

  • Stalk or repeatedly contact another person against their wishes;

  • Exploit, endanger or harm a child or vulnerable person;

  • Engage in sexual exploitation or grooming of a minor;

  • Impersonate another person or organisation;

  • Misrepresent your identity or intentions;

  • Engage in fraud or deception;

  • Request, obtain or share passwords, verification codes or financial information;

  • Share illegal content;

  • Infringe another person's intellectual property rights;

  • Distribute spam or unsolicited communications;

  • Attempt to gain unauthorised access to another account or system;

  • Interfere with the security or operation of Tutch;

  • Introduce malware, viruses or other harmful technology;

  • Use automated systems to scrape or access the Services without authorisation;

  • Circumvent age restrictions, safety measures or account restrictions; or

  • Use Tutch for any unlawful, harmful or fraudulent purpose.

We may take action against accounts that breach these rules, including restricting access, suspending accounts or permanently terminating accounts.

7. Communications With Other Users

Tutch enables users to communicate directly with other users in real time.

You are responsible for your conduct and communications when using the Services.

We do not control every interaction between users and cannot guarantee the identity, intentions, behaviour or conduct of another user.

You should exercise caution when communicating with people you do not know.

You should not share sensitive information, including:

  • Passwords;

  • Financial information;

  • Bank details;

  • Verification codes;

  • Government identification details;

  • Home addresses; or

  • Other information that could place you at risk.

If you believe that another user is behaving inappropriately, unlawfully or in breach of these Terms, you should use available reporting or blocking features or contact us at russell@tutch.me.

If you believe someone is in immediate danger, contact the relevant emergency services.

8. Protection of Children and Young Users

Tutch does not permit users under the age of 13.

Users must not use Tutch to exploit, endanger, abuse, groom or otherwise harm a child or young person.

We may take immediate action, including account suspension or termination, where we reasonably believe that a user:

  • Is under the minimum permitted age;

  • Has provided false information about their age;

  • Is attempting to exploit, groom or harm a child or young person;

  • Is sharing or attempting to obtain illegal sexual content involving minors; or

  • Is otherwise creating a risk to the safety of another user.

Where required or appropriate under applicable law, we may report suspected illegal activity to relevant authorities.

Nothing in these Terms prevents us from taking urgent action where reasonably necessary to protect users.

9. Live Video and Audio Communications

Tutch enables live video and audio communications between users.

The quality and availability of communications may depend on factors outside our control, including:

  • Your internet connection;

  • Your device;

  • Your network provider;

  • The device and connection of other users; and

  • Third-party infrastructure.

We do not guarantee uninterrupted, delay-free or error-free communications.

You are responsible for ensuring that your use of live communication features complies with applicable laws.

You must not use Tutch to secretly record, monitor or intercept another person's communications where doing so would breach applicable law.

Tutch currently provides live communication features and does not currently provide users with a feature to record calls through the Services. If recording, storage or other communication features are introduced in the future, additional terms or notices may apply.

10. Augmented Reality and Interactive Features

Tutch may provide augmented reality, visual effects and other interactive features.

These features are intended for communication and entertainment purposes.

You must use Tutch safely.

Do not use the Services while:

  • Driving;

  • Operating machinery;

  • Crossing roads;

  • Performing dangerous activities; or

  • Engaging in any activity requiring your full attention.

11. User Conduct and Responsibility

You are responsible for your actions when using Tutch.

You must treat other users respectfully.

You must not:

  • Pressure another user into communicating with you;

  • Continue contacting someone who has clearly indicated that they do not wish to communicate;

  • Attempt to circumvent another user's blocking or privacy settings;

  • Create multiple accounts to evade a suspension or block;

  • Use another person's identity or account without permission; or

  • Use Tutch to organise or facilitate harmful, illegal or abusive activity.

We may investigate suspected breaches of these Terms and take appropriate action.

12. Reporting, Blocking and Enforcement

Tutch may provide features allowing users to block or report other users.

If you encounter behaviour that you believe breaches these Terms, we encourage you to report it using the available reporting tools.

We may review reports and take action that we consider reasonably appropriate, including:

  • Issuing warnings;

  • Removing or restricting access to features;

  • Temporarily suspending an account;

  • Permanently terminating an account; or

  • Reporting suspected unlawful activity where required or appropriate.

We are not required to take any particular action in response to every report.

Our failure to immediately act on a report does not mean that the conduct is permitted or approved.

13. Intellectual Property

The Tutch name, branding, logo, software, technology, designs, user interface, graphics, features and other content forming part of the Services are owned by or licensed to Mobile Chat Limited and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, Mobile Chat Limited grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Services for their intended purpose.

You must not:

  • Copy, reproduce or modify the Services except where permitted by law;

  • Reverse engineer, decompile or attempt to extract source code except where legally permitted;

  • Sell, lease, sublicense or commercially exploit the Services without our prior written permission;

  • Remove proprietary notices; or

  • Use Tutch's intellectual property without prior written permission.

14. Third-Party Services

Tutch may rely on or interact with third-party services, including telecommunications providers, cloud hosting providers, application stores and other technology providers.

Those services may be subject to separate terms and privacy policies.

We are not responsible for the availability, content, security or practices of third-party services that we do not control.

15. App Stores

If you download Tutch through the Apple App Store, Google Play or another application marketplace, your use of the application may also be subject to that platform's applicable terms and conditions.

Where required by an application distribution platform, additional platform-specific terms may apply.

These Terms are between you and Mobile Chat Limited, except where applicable law or platform terms state otherwise.

16. Availability of the Services

We will use reasonable efforts to provide the Services.

However, we do not guarantee that Tutch will always be:

  • Available;

  • Uninterrupted;

  • Error-free;

  • Secure; or

  • Compatible with every device.

The Services may be temporarily unavailable because of maintenance, updates, technical problems, network failures, security issues or circumstances outside our reasonable control.

We may modify, suspend or discontinue parts of the Services where reasonably necessary.

17. Suspension and Termination

You may stop using Tutch at any time.

We may suspend, restrict or terminate your account where we reasonably believe that:

  • You have breached these Terms;

  • Your account is being used unlawfully or fraudulently;

  • Your use creates a risk to other users;

  • We are required to do so by law; or

  • Continued access could reasonably expose Mobile Chat Limited, Tutch or other users to harm.

Where reasonably appropriate, we may provide notice before suspending or terminating an account.

You may request deletion of your account in accordance with the account deletion process made available within the Services or by contacting us at russell@tutch.me, subject to applicable law and our legitimate requirements to retain certain information.

18. Disclaimer

The Services are provided on an "as available" basis.

To the maximum extent permitted by applicable law, we do not guarantee that:

  • The Services will meet every user's requirements;

  • Communications will always be successfully established or maintained;

  • Other users will behave appropriately;

  • The Services will always be available; or

  • The Services will be free from all errors or interruptions.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer protection law.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Subject to applicable law, Mobile Chat Limited will not be liable for indirect or consequential losses, including loss of:

  • Profits;

  • Business;

  • Revenue;

  • Goodwill; or

  • Data,

arising from your use of the Services.

Mobile Chat Limited is not responsible for the actions, communications or conduct of other users except where liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;

  • Death or personal injury caused by negligence; or

  • Any other liability that cannot lawfully be excluded.

20. Changes to These Terms

We may update these Terms from time to time.

Where changes are material, we will take reasonable steps to notify users. Notification may be provided through:

  • The Tutch application;

  • The Tutch website; or

  • The email address associated with your account.

The revised Terms will take effect on the date stated in the updated version.

Your continued use of the Services after the revised Terms take effect may constitute acceptance of the revised Terms to the extent permitted by applicable law.

21. Privacy

Your use of Tutch is also governed by our Privacy Policy.

The Privacy Policy explains how Mobile Chat Limited collects, uses, stores and protects personal information.

You should read the Privacy Policy carefully before using the Services.

22. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident in another country, you may also benefit from mandatory consumer protection laws applicable in your country of residence.

Where permitted by applicable law, disputes arising from these Terms or the Services will be subject to the courts of England and Wales.

24. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented to you in connection with specific features of the Services, constitute the agreement between you and Mobile Chat Limited regarding your use of Tutch.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force to the extent permitted by law.
